IVY Entertainment takes your privacy seriously. This policy explains what information we collect, why we collect it, how we use and protect it, and the choices and rights you have over your data.

This privacy policy (the "Privacy Policy") governs the personal information and/or sensitive personal data or information ("SPDI") that may be collected, received, possessed, stored, dealt with or handled by IVY Entertainment in the course of providing its services, or while availing services from any third party or person — whether in physical or electronic mode, including through this website.

"IVY Entertainment" shall mean and include IVY Entertainment Private Limited, its music division IVY Music (also branded ICON Music), and all respective group companies, subsidiaries, affiliates and any person who collects personal information or SPDI on behalf of IVY Entertainment (collectively, "IVY Entertainment" / "We" / "Us").

We are committed to treating data privacy seriously. It is important that you know exactly what we do with your information. This Privacy Policy sets out the basic principles we follow for collecting, using, storing, disclosing and protecting information in compliance with applicable laws.

What Information We Collect

We strive to collect only the personal information or SPDI that is necessary for us to provide services, or to avail any services, under a lawful contract or through the use of this website. "Personal Information" and "SPDI" carry the meaning defined under the Information Technology Act, 2000 and the IT Rules, 2011 — broadly, any information that identifies you, directly or indirectly, as a particular individual.

a) Information you provide to us

We may collect personal information when you use our services, contact us through our complaint or grievance process, or interact with our service providers. This may include:

  • Name
  • Gender
  • Mobile number
  • Email address
  • Postal / home address
  • IP address

When you provide information via a third-party site or platform (for example, a social login such as Google or Facebook), the information we collect through those linked services is covered by this Privacy Policy, while the information the third party collects is subject to that third party's own privacy practices. Our site may contain links to other websites we do not control; we are not responsible for their privacy practices, and we encourage you to read their policies.

b) Information collected automatically

We use cookies and similar electronic tools to improve the responsiveness of the site and to assign each visitor a unique, random identifier so we can understand individual interests. Unless you voluntarily identify yourself (for example, through a form), a cookie alone does not tell us who you are. A cookie can only contain information you supply and cannot read data off your hard drive. See the Cookies section for details.

c) Information from third parties

We may receive information about you from other sources — such as platform partners for whom we provide services — and add it to our records, treating it in accordance with this policy. We may also obtain updated contact information from third parties to correct our records and fulfil our services.

d) Demographic & analytics information

We use analytics tools, including Google Analytics, to understand how visitors use our website. The resulting reports are anonymous and cannot be associated with any individual. You can opt out of Google Analytics using Google's browser opt-out tools and Ads Settings.

e) Information for advertising

When we share audience information with advertisers, it is usually in the form of aggregated traffic statistics. We do not provide personally identifiable information to third-party advertisers or ad-servers without your consent. Third parties may use non-identifying information about your visits to provide advertisements relevant to your interests.

f) Children's information

Protecting the privacy of the young is especially important to us. We do not knowingly collect or maintain information from anyone we know to be under 18 years of age, and no part of our services is structured to attract or deal with anyone under 18.

How We Use Your Information

We collect and process personal information only in a lawful manner, to provide, analyse, administer, enhance and personalise our services and communications. We may use your information to:

  • Fulfil our obligations to deliver the services you have availed, and contact you if a problem arises;
  • Notify you, where you have agreed, about new services that may interest you;
  • Inform you of contest results or general contest information, where you take part;
  • Invite you to participate in surveys, contests, or to provide feedback;
  • Improve your experience on our website through cookies and analytics;
  • Tell you about our events, or third-party events where IVY is a media partner;
  • Send communications about our activities, where you have opted in.

Marketing

We may send you information about new releases, services, events and promotions that may interest you. If you have consented to receive marketing, you can opt out at any time by emailing us at privacy@ivymusic.in. We may also use your email address, without further consent, for non-marketing or administrative purposes such as service notices, billing, and handling requests, enquiries and complaints.

When we may share without prior consent

We may share your information with a third party without prior consent only where:

  • It is requested or required by law, a court, or a governmental or regulatory authority — including for verification of identity, or the prevention, detection or investigation of offences and cyber incidents;
  • It is shared within our group companies, and their officers and employees, solely to process information on our behalf for providing the services — subject to confidentiality and security commitments;
  • It is presented to advertisers as aggregated statistics on traffic to pages within our site.

If you decline to submit personally identifiable information, we may be unable to provide certain services. We will not be liable for the denial of such services in that case.

How We Protect Your Information

We implement reasonable security practices and procedures — managerial, technical, operational and physical — that are commensurate with the information we handle and the nature of our business. Our databases are stored on servers secured behind a firewall, with password-protected and strictly limited access.

However effective our measures, no security system is impenetrable. We cannot guarantee the absolute security of our database, nor that information you transmit to us over the internet will not be intercepted. Any information you post in public areas is available to anyone with internet access.

Children's privacy

This website is not designed for or directed at minors. We do not knowingly permit any person below the applicable legal age to register or provide personal information. If we become aware that such information has been collected without verified parental consent, we will take appropriate steps to delete it and notify the parent. If you believe a minor has provided us information without consent, please contact us so we can remove it.

Global Data Transfer & Storage

We operate globally and may transfer your personal information to companies within our group, or to third parties, in locations around the world for the purposes described in this Privacy Policy. Wherever your personal information is transferred, stored or processed, we take reasonable steps to safeguard its privacy.

When using or disclosing personal information transferred from the European Union, we rely on standard contractual clauses approved by the European Commission, or other means recognised under European Union law, to ensure adequate safeguards.

Data Retention

We retain personal information and SPDI for as long as necessary to support our legitimate business interests and to comply with our legal obligations or perform a lawful contract. Once the purpose is fulfilled, we take reasonable efforts to erase the information. We may, however:

  • Retain information as necessary for legitimate business interests — such as records, fraud detection, prevention, and enhancing security and safety;
  • Retain and use information to the extent necessary to comply with legal obligations — for example, for tax, legal reporting and auditing requirements.

Your Rights & Control Over Your Data

You may withdraw your consent regarding the use of your information at any time by emailing privacy@ivymusic.in. We will review the request, verify whether it concerns personal information or SPDI, and — once verified — withdraw consent and stop further handling of that information.

You may also write to us to correct any inaccurate or incomplete information you have provided. While we comply with requests to edit or delete information, we may retain backup copies to the extent necessary to comply with our legal obligations.

Cookies

Cookies are small text files that websites save locally to your device, allowing the site to store and use information during your visit. They can improve your experience by remembering your preferences, and by measuring how you use a site so we can improve it.

  • None of the cookies we use can identify you personally — they simply help us make the site better for you.

  5. A statement, under penalty of perjury, that the information is accurate and belongs to you.

Staying Safe — Need to Know

Protect yourself from fraud

IVY Entertainment does not solicit confidential details such as your OTP, CVV, PIN, card number or bank account details through any means. We never call users with offers, discounts or free gifts.

Fraudsters may use techniques such as "phishing" to contact, influence and defraud users. Please do not share any personal or payment-sensitive information with unknown persons — doing so can lead to unauthorised use, fraud and financial loss.

IVY Entertainment shall not be liable for any loss, damage or expense incurred where you have shared sensitive information with anyone impersonating us. We encourage you to report such attempts to our Grievance Officer at grievance@ivymusic.in so we can investigate and explore legal recourse.
